Forensic Genealogy is the term used for the process of identifying Distributees and providing the documentation to the person settling the estate on behalf of the Decedent, who must file this information with the Court.When a person dies with a Last Will and Testament, he or she is a Testator.
The person charged with settling the estate is called the Executor if he is male, or the Executrix if she is female. When person dies without a Last Will and Testament, he or she is considered to have died Intestate. The person charged with settling the estate is called the Administrator if he is male, or the Administratrix if she is female. In both cases, with or without a Will, we refer to the deceased person as the Decedent. Using a New York State example, in order to settle the Decedent's estate, there is a process at the County Surrogate's Court, where the person settling the estate provides detailed information about the Decedent's closest relatives and whether or not they are living. These living relatives are called Distributees. When the list of Distributees has been compiled, together with documents proving relationships, aFamily Tree is then created which is a visual depiction of the relationships between the Decedent and the Distributees. This family tree is attached to an Affidavit of Due Diligence or Affidavit of Heirship, which is the statement of facts based on the research conducted to identify these relatives. Documents which prove relationships may be vital records, which are the records of life events, such as birth, marriage, death, and the like. Other documents may be used as well, especially if persons identified in the research have similar names to other persons. Authored by Cornelia Wendell Bush Smith's Clove, the present-day Village of Monroe, NY, is named for its first settler, David Smith. He came from Long Island, purchased two lots of the Cheesecock Patent, and developed a farm, orchards and a grist mill. He and his sons lived in peace for a short while before the outbreak of the American Revolution. As Loyalists, they were harried, their property was seized, David himself was incarcerated on a ship on the Hudson River. Members of his family were executed, and a few escaped to Canada. His farm became the Village of Monroe at its incorporation in 1894. Members of our community came together to commemorate the Centennial of that event, and we published a book called the Celebration of the Century, the History of the Village of Monroe. At that time, I provided a portion of this book and allowed it to be incorporated into that one. Originally drafted in 1993, this is the 2015 edition. About the Author: Cornelia Wendell Bush is the former President of the Heritage Preservation Committee of Monroe, Vice President of the Town of Monroe Historical Society, and served on the Village of Monroe's Architectural Appearance Review Board, Planning Board, and Centennial Committee. She also served as the National Co-Chairman for Marking & Preservation of Historic Sites of the National Society Colonial Dames XVII Century, headquartered in Washington, DC. Cornelia was subsequently sworn in as the sixth Orange County Historian, and is the first woman to hold the Office. She is the six-greats granddaughter of David Smith, first settler of Smith's Clove, the present-day Village of Monroe. She graduated from the University of Virginia, Thunderbird/The American Graduate School of International Management, the nonprofit management program of Duke University, the Publishing Institute of New York University, and is a life member of Phi Sigma Iota International Honor Society. She is active in hereditary societies as a means of honoring her ancestors and preserving historic sites and structures.
